Terms of Use

These Terms of Use (“Terms”) govern your access to and use of talonbuilt.ca and any related pages, content, forms or communications (the “Site”), operated by Talon Built (“Talon”, “we”, “us”, “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About Talon

Talon Built is a construction and general contracting business operating in Kenora and the surrounding Lake of the Woods region of Ontario. These Terms apply only to your use of the Site. Any construction, renovation, carpentry, marine or related services we provide are governed by a separate written agreement between Talon and the client. Nothing on the Site is an offer, bid, quote or binding commitment to perform work.

2. No Reliance on Site Content

Content on the Site is provided for general information. Project descriptions, timelines, capabilities and images illustrate past or representative work and do not guarantee any particular result, price or schedule on your project. Construction pricing depends on site conditions, access, materials and scope, and can only be established after a site assessment and a written estimate.

3. Enquiries and Submissions

When you submit an enquiry, photos, drawings or other materials through the Site, you confirm that you have the right to share them and you grant us permission to use them for the purpose of assessing and responding to your enquiry. Do not submit confidential information belonging to a third party. Our handling of personal information is described in our Privacy Policy.

4. Intellectual Property

The Site and its contents, including text, graphics, logos, marks, images, photographs, layout and code, are owned by Talon Built or its licensors and are protected by Canadian and international copyright, trademark and other intellectual property laws. “Talon”, “Talon Built”, the talon mark and related logos are trademarks of Talon Built. You may view and print pages for your own personal, non-commercial use. Any other reproduction, modification, distribution or republication requires our written permission.

5. Acceptable Use

You agree not to use the Site to: (a) break any law; (b) interfere with or disrupt the Site or its infrastructure; (c) attempt to gain unauthorized access to any system; (d) scrape, harvest or collect information about others; (e) transmit malware, spam or unsolicited commercial messages; or (f) misrepresent your identity or affiliation.

6. Third-Party Links

The Site may link to third-party websites or services. We do not control them and are not responsible for their content, products or practices. Links are provided for convenience and do not imply endorsement.

7. Disclaimer

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error free, or free of viruses or other harmful components.

8. Limitation of Liability

To the fullest extent permitted by law, Talon Built and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to your use of the Site, even if we have been advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Indemnity

You agree to indemnify and hold harmless Talon Built and its owners, employees and contractors from any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party.

10. Changes to the Site and Terms

We may change, suspend or discontinue any part of the Site at any time. We may also update these Terms; the revised version takes effect when posted, and the “Last updated” date above will change. Continued use of the Site after a change means you accept the revised Terms.

11. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it, without regard to conflict of laws principles. You agree to the exclusive jurisdiction of the courts of Ontario for any dispute arising out of or relating to these Terms or the Site.
